CCR's (Covenants, Conditions & Restrictions) are written rules, limitations and restrictions on use, mutually agreed to by all owners of Portal III.  This is a legal document that lays out the guidelines for the Portal III community.  CCR's are enforced by the homeowners association. They contain limitations and restrictions on various subjects such as home additions, landscaping, fencing, and more.

By-Laws are a set of rules that govern the homeowners association.  The bylaws govern how the HOA operates and contains the information needed to run the HOA as a business.  The bylaws cover matters such as; meetings, how meetings are conducted, duties and terms of directors, the number of directors, and membership voting rights.

NOTICE - April 2018:

 

There has been a recent violation of our CC&Rs concerning short-term rentals.

​

Since we have some new lot owners, and with the summer season approaching, your Board wants to remind everyone that our CC&Rs do not allow rentals less than six (6) months in duration.

 

For newer lot owners, in 2014 by a nearly 80% yes vote of all lot owners, it was agreed to require a minimum six-month rental period within our Portal.

Also, a written and signed rental agreement contract must be provided to your Board for approval prior to any rental commencing.

Violation of this CC&R restriction – Section 2(a) will result in a $250 basic fine, plus additional daily fines of $150.

As previously mentioned, the recent Arizona State Senate Bill 1350 does not prevent HOA’s from restricting short-term rentals.

As lot owners we are all contractually bound by the Association’s governing documents and applicable restrictive covenants. Your adherence to these conditions is most appreciated.
